End user licence agreement

Draft, last updated 20 October 2026. Also published at https://www.openretouch.com/eula/

This agreement is between you and DataDine sp. z o.o., ul. Żabiniec 85/60, 31-215 Kraków, Poland, KRS 0001062828, NIP 9452280600 ("we", "us"). It covers the OpenRetouch Photoshop plugin, the local OpenRetouch engine and the files installed with them (the "Software"). By installing or using the Software you accept this agreement. If you do not accept it, do not install the Software. Our Terms of Service (https://www.openretouch.com/terms/) also apply. If the two conflict, the Terms of Service prevail.

1. Licence

We grant you a personal, non-exclusive, non-transferable licence to install and use the Software for your own work, including commercial photography and client work. The Free plan may be used on any number of your own computers. Pro, when you subscribe, may be active on up to two computers at a time.

2. What you may not do

You may not:

  • sell, rent, lend, sublicense or distribute the Software, or share your account;
  • remove, disable or circumvent the licence check, the Pro feature gates or the device limit;
  • copy, modify, decompile or reverse engineer the Software, except where the law expressly allows it and only to that extent;
  • remove copyright, trademark or licence notices.

3. Ownership

The Software is licensed, not sold. We and our licensors keep all rights in it. Copyright (c) 2026 DataDine sp. z o.o. All rights reserved.

4. Third-party components and AI models

The Software includes open-source components and downloads AI models made by third parties. Those components and models are licensed under their own licences, listed in THIRD_PARTY_NOTICES.txt in the installation folder. Nothing in this agreement limits your rights under those licences.

5. Your photos

The Software processes your images on your own computer. It does not send your images to us or anyone else. The engine contacts our licence server only to sign in, to check your Pro subscription and to check for updates. See our Privacy Policy: https://www.openretouch.com/privacy/

6. Updates

We may provide updates. Some updates may be required to keep Pro working, for example when the licence check changes.

7. Warranty

The Software is provided as is, to the extent the law allows. Always keep backups of your original files. If you are a consumer, you keep all rights the law gives you, including the right to have digital content and services that conform to the contract.

8. Liability

To the extent the law allows, we are not liable for indirect damage, lost profits or lost data. Our total liability to business users is limited to the fees you paid us in the 12 months before the claim. These limits do not apply to damage caused intentionally or by gross negligence, and they do not limit consumer rights.

9. Ending the licence

You can end this agreement at any time by uninstalling the Software. It ends automatically if you seriously breach it. When it ends, stop using the Software and delete it.

10. Law

Polish law applies. If you are a consumer, you keep the protection of the mandatory laws of the country where you live.
